The Hardest Permit Test in America, Ranked
All 50 states, scored on published rules only Β· Updated July 12, 2026
Most "hardest DMV test" lists rank states by self-reported failure rates nobody can verify. This ranking uses only published, checkable rules from each state's official driver manual: the passing bar, section-scoring rules, test length, and how painful a failure is (waits, caps, fees). By that measure, the strictest written test in America is Virginia's (85% to pass, perfect 10/10 on road signs), and the most forgiving is New Mexico's (70%, 25 questions).

Methodology
Each state's score (0β100) is computed from its official published exam contract, verified against the state's driver manual or licensing agency (JuneβJuly 2026):
- Passing bar β 50 points. The percentage required on the standard adult exam, scaled from 70% (the national floor) to 88% (the strictest published standard).
- Structural rules β 20 points. Section minimums (e.g. a required score on road-sign questions alone), perfect-section requirements, time limits, and longer exams for under-18 applicants.
- Test length β 15 points. More questions means more sustained accuracy at the same percentage; scaled from the shortest standard exam (18 questions) to the longest (50).
- Retake friction β 15 points. Documented waiting periods, attempt caps, and retake fees. Where a state publishes no retake rule, it scores zero here (noted as βββ) rather than being penalized on rumor.
What this ranking deliberately does not use: failure rates. No state publishes audited pass/fail statistics for the knowledge test, so any ranking built on them is built on survey self-reports. Every input to this ranking can be checked against an official source β that's the point. Test formats change; the verification date at the top is the promise.
Common questions
Which state has the hardest permit test?
Virginia, by published rules: 85% to pass, plus perfect 10/10 on road signs.
Which state has the easiest permit test?
New Mexico β 25 questions at 70%. "Easiest" still means studying: the questions come from the same handbook material as everywhere else.
Does a harder test mean safer drivers?
The research is mixed β graduated-licensing rules (supervised hours, night restrictions) show stronger safety effects than test difficulty. See our permit-age and GDL lookup for those rules by state.
